Marcie will help craft a defense strategy specific to your case and your desired outcome.  Many times it is a good idea to file what is called a “Trial by Declaration.”  This is essentially doing a traffic trial on paper.  The reason why it is often helpful to start with a Trial by Declaration is that if the officer does not respond to the paperwork within a set period of time, the Court dismisses the ticket.  If the officer does respond, then the Court will review the paperwork.  If the Court finds you guilty, you still have the ability to request an in-person court trial for your ticket.  If the officer does not appear, the Court will dismiss your ticket.  If the officer does appear, you are still able to present your entire case.  In certain courthouses, you may be required to post the face amount of your ticket at the time you file the Trial by Declaration paperwork.  If you win, the Court returns your money.
